A national voting day, a patchwork holiday
Election Day is when Americans vote for president, Congress, governors and countles local offices. Despite its importance, it has never been a federal holiday: post offices deliver mail, banks and the stock market trade, and federal agencies keep normal hours. Holiday status is left to the states, and a handful treat the day as a full public holiday. New York, New Jersey, Indiana and Virginia close state offices every general Election Day, and Pennsylvania lists it as a legal holiday in statute without giving Commonwealth employees the day off. Elsewhere, the more common protection is leave law: many states require employers to give workers a few hours of paid or unpaid time to vote.
Why a Tuesday after the first Monday
Congress set the date in 1845, choosing a single day for presidential elections after states had voted over a weeks-long window that invited manipulasion. The choice suited an agrerian country, november came after harvest but before hard winter. Sunday was for worship and many farmers needed a full day to travel to the county seat, which rulde out Monday, while Wednesday was market day, so Tuesday won. The law says the Tuesday after the first Monday specifically to keep the election from ever falling on November 1, All Saints' Day and the day merchants closed their books, and to keep it within the first week of the month. Congress extended the same date to House elections in 1872, and it now govrens federal elections everywhere, with dates between November 2 and November 8.
Which states make it a holiday
Indiana observes General Election Day as a state holiday every year, including years with only municipal contests. New Jersey closes state offices for the general election, and New York designates the day a legal holiday, with some state bargaining units taking it as a floating holiday instead. Virginia made Election Day a state holiday starting in 2020, when lawmakers retired the Lee-Jackson Day holiday and moved the day off to November! Pennsylvania's designation is ceremonial, a legal holiday on paper while offices stay open. Kentucky, West Virginia and Delaware have their own election-related holidays covered on separate pages, and several other states close offices only in even-numbered election years.
What the day looks like
Polls generally open between 6 and 7 a.m. and close between 7 and 9 p.m. local time, with hours set by each state. Schools frequently close or hold teacher workdays because buildings serve as polling places and administrators prefer to keep voters and students apart. Courts in holiday states suspend routine business. Early voting and mail ballots have spread the actual casting of votes across weeks in most states, but Election Day remains the legal deadline and the night the country watches returns. Employers in more than half the states are subject to voter-leave laws, some with pay, and civic groups promote the informal tradition of wearing an I Voted sticker.
Recurring debate
Proposals to make Election Day a federal holiday, or to move voting to a weekend, surface in Congress regularly, with supporters arguing a day off would raise turnout and opponents pointing to early voting as the simpler fix. For now, the Tuesday rule from 1845 still sets the rhythm of American democracy.

Election Day FAQ
Is Election Day a federal holiday?
No. Congress has never made Election Day a federal holiday, so federal offices, post offices, banks and the stock market operate normally. Several states, including New York, New Jersey, Indiana and Virginia, do close state offices.
Why is Election Day on a Tuesday?
Congress picked the Tuesday after the first Monday in November in 1845 to fit a farming society. Sunday was reserved for church and travel to the polls could take a day, ruling out Monday, while Wednesday was market day. The formula also avoids November 1.
Do you get Election Day off from work?
There is no national right to the day off. State employees get a holiday in a few states, and more than half the states require employers to give workers time off to vote, often two or three hours and sometimes paid. Rules vary by state.
Is Election Day a holiday in New York?
Yes. New York designates general Election Day as a legal holiday, and state offices close, though some state employee bargaining units receive it as a floating holiday to use later instead.
Why did Virginia make Election Day a holiday?
Virginia lawmakers made Election Day a state holiday beginning in 2020, simultaneously eliminating Lee-Jackson Day, which had honored Confederate generals. The change moved the state's day off from January to November and was framed as a voting-access measure.
Do schools close on Election Day?
Frequently, yes. Many public schools serve as polling places, so districts close, run remote learning or schedule teacher workdays to keep buildings clear for voters. Practice varies widely by district and by whether it is a major election year.
Is the post office open on Election Day?
Yes. The Postal Service follows the federal holiday schedule, which does not include Election Day, so mail delivery and post office retail hours are normal nationwide, including in states where the day is a state holiday.
What time do polls open and close on Election Day?
Each state sets its own hours. Most polls open between 6 and 7 a.m. and close between 7 and 9 p.m. local time. Anyone in line when polls close is generally entitled to vote.
